These Terms apply when you visit our website, schedule an appointment, purchase a product or service, or receive services from MIHSA Aesthetics.
By using our website or services, you agree to these Terms.
MIHSA Aesthetics is operated by Sujan Gurung Nurse Practitioner in Family Health PLLC and Gurung Global LLC, doing business as MIHSA Aesthetics, collectively referred to as “MIHSA,” “we,” “us,” or “our.”
2. Services and Treatment Eligibility
MIHSA provides medical aesthetic, cosmetic, skincare, laser, and wellness services. All services are subject to consultation, provider availability, and clinical eligibility.
Before receiving treatment, you must:
- Complete the required intake forms
- Provide accurate health and medication information
- Disclose allergies, medical conditions, pregnancy, or nursing
- Sign the applicable treatment-consent forms
MIHSA may decline, postpone, or modify a treatment when clinically appropriate. Individual results vary and cannot be guaranteed.
3. Medical Disclaimer
Information on our website, social media, emails, and text messages is provided for general educational purposes. It does not replace an individualized medical evaluation, diagnosis, or treatment recommendation.
A consultation or appointment request does not guarantee that you are eligible for a service.
Do not use our website, email, text messages, or social media for a medical emergency. Call 911 or seek immediate medical care.
4. Appointments and Deposits
Advance booking is recommended, and appointments are subject to availability.
A deposit is required to schedule an in-person consultation, virtual consultation, treatment, or procedure. Your appointment is not confirmed until the required deposit has been received.
The deposit will be applied toward your treatment balance at checkout. Any unused deposit expires after 90 days from the date of consultation.
5. Cancellations, Rescheduling, and No-Shows
Please provide at least 24 hours’ notice if you need to cancel or reschedule.
- Cancellations or rescheduling requests made less than 24 hours before an appointment are subject to a fee.
- Missed appointments and no-shows are subject to a fee.
- Repeated late cancellations or no-shows may require full prepayment for future appointments.
- Outstanding fees must be paid before another appointment can be scheduled.
These policies apply to both in-person and virtual appointments.
6. Virtual Consultations
You are responsible for being available at the scheduled time with a reliable internet connection, working camera and microphone, and a private location.
A virtual consultation does not guarantee eligibility for treatment. MIHSA may require an in-person evaluation before providing a treatment or prescription.
7. Payments and Pricing
Payment is collected during your appointment and must be completed before treatment begins.
MIHSA may require a valid payment method for deposits, cancellation fees, no-show fees, memberships, packages, or payment plans.
Prices may change at any time. The price confirmed for your appointment will apply unless otherwise disclosed.
Third-party financing is subject to the financing provider’s separate approval requirements and terms.

All treatments require an appropriate consultation, health history, and informed consent.
Treatments may involve risks, side effects, limitations, and recovery time. You are responsible for following all pre-treatment and post-treatment instructions and notifying MIHSA promptly of any concerns.
Results vary based on individual factors and cannot be guaranteed. Before-and-after photographs and testimonials show individual experiences and do not promise the same results for every client.
9. Final-Sale and Refund Policy
Services are final sale once treatment has begun or been completed. Products are final sale once opened or used.
Refunds are not issued for:
- Completed services
- Partially used or completed packages
- Opened or used skincare products
- Missed or no-show appointments
- Cancellation or rescheduling fees
- Expired deposits
- Membership payments that have already been processed
- Dissatisfaction based solely on individual results
Nothing in these Terms limits a refund or legal remedy that cannot be waived under applicable law.
10. Client Satisfaction
Your satisfaction matters to us. Please contact MIHSA promptly if you have questions or concerns following a treatment.
When appropriate and at MIHSA’s discretion, we may offer a follow-up evaluation, treatment adjustment, service credit, or alternative treatment.
Offering one of these options does not guarantee a refund or complimentary service and does not constitute an admission of fault.
11. Text Messages and Emails
We may use the contact information you provide to send appointment confirmations, in-person or virtual appointment reminders, care-related notices, service updates, promotions, and skin and wellness tips.
Message frequency varies, and message and data rates may apply. Consent to receive marketing messages is not a condition of receiving treatment.
You may opt out of marketing text messages by replying STOP or unsubscribe from marketing emails using the link provided. We may continue sending non-marketing communications when necessary to manage an appointment or provide a requested service.
12. Privacy
Our collection and use of personal information are governed by our Privacy Policy and, when applicable, our Notice of Privacy Practices.
Email and standard text messages may not always be secure. Do not use these methods for emergencies or urgent medical concerns.

Nothing in these Terms limits liability for professional negligence, medical malpractice, gross negligence, intentional misconduct, or any liability that cannot legally be limited.
15. Indemnification
You agree to protect, indemnify, and hold MIHSA and its owners, providers, employees, contractors, agents, and service providers harmless from claims, damages, losses, costs, or reasonable attorneys’ fees resulting from your violation of these Terms or unlawful or unauthorized use of the website.
This provision does not apply to MIHSA’s professional negligence, medical malpractice, gross negligence, intentional misconduct, or any liability that cannot legally be limited.
16. Dispute Resolution and New York Law
MIHSA and the client agree to first attempt to resolve disputes informally and in good faith.
If a dispute cannot be resolved, it will be governed by the laws of the State of New York and handled by a court with appropriate jurisdiction in New York County, New York.
Nothing in these Terms limits any legal or consumer right that cannot be waived.
17. Changes to These Terms
We may update these Terms periodically. Changes become effective when the revised Terms are posted on our website unless another effective date is stated.
Your continued use of our website or services after an update constitutes acceptance of the revised Terms.
